Abstract
This article provides basic information on trademark rights and the procedures to be followed for securing those rights. It discusses the selection of trademarks and the advantages to obtaining federal trademark registration. The article sets forth the proper manner of trademark usage, so as to avoid a finding of abandonment or genericism of a mark. In this context, the assignment and licensing of trademarks are considered, with a focus on good will and quality control. Registration procedures, as well as the maintenance, protection, and enforcement of registrations, in the United States and foreign countries, are also treated. Issues of foreign priority are considered in connection with various international trademark treaties.
